Terms and Conditions of Your Agreement with Kila Marketing
1. Acceptance of Terms
Please read these Terms and Conditions (“Terms”) carefully before using the Kila Marketing website (www.kilamarketing.com.au), which is operated by Kila Enterprises Pty Ltd trading as Kila Marketing (ABN 64 679 757 405, ACN 679 757 405) (“we”, “us”, or “our”). By accessing and using our Service, you accept and agree to be bound by these Terms. These Terms apply to all visitors, users, and others who access or use the Service. Your agreement is confirmed by selecting the ‘I’ve read & accepted the terms & conditions’ checkbox during the sign-up process on our website.
2. Legal Agreement
This document, including any amendments or written agreements later agreed upon, constitutes the entire agreement between you (the Client) and us regarding our Services.
3. Payments
- No setup fee: We do not charge a setup or onboarding fee.
- Monthly billing: Our services are billed monthly in advance, starting from the day your service begins. The amount is stated in your proposal or agreement. Payments are charged to your nominated payment method unless otherwise agreed in writing.
4. Month-to-Month Agreements
All of our services are provided month to month. There are no fixed terms, no minimum terms and no automatic renewals into a new term. Your agreement continues each month until either you or we end it under section 6.
5. Pausing Services
If you would like to pause your services, let us know in writing and we will agree the pause and the restart date with you. Billing stops for the agreed pause period. There is no fee for pausing.
6. Ending Your Agreement
- Notice: Either you or we may end the agreement at any time by giving 30 days written notice (email is fine).
- During the notice period: Services continue and are billed as normal until the end of the 30 days.
- No termination fees: There are no cancellation, early termination or exit fees. You only pay for services provided up to the end of the notice period, and any outstanding invoices are due within 7 days of the agreement ending.
7. Late Payment
Failure to pay invoices within 7 days after due may result in debt recovery actions at your expense. This includes penalties and legal fees.
8. Google Ads Management
We will manage your Google Ads account and will aim to optimise it. However, we are not liable for the performance of the ads or for any costs that Google may charge. You must manage and maintain your relationships with Google and any third-party platforms independently.
9. Search Engine Optimisation (SEO)
We provide SEO services aimed at improving your website’s search engine ranking. However, due to the unpredictable nature of SEO, we do not guarantee specific rankings or results.
10. Modifications to Terms
We may modify these Terms at any time. Updated terms will be posted on our website. By continuing to use our services after these changes are posted, you agree to the revised terms.
11. Marketing Attribution
As part of our service, we reserve the right to include a discreet attribution link stating “Marketing by Kila Marketing” in the footer of your website. This link will be placed in a non-intrusive manner and will link back to our website (www.kilamarketing.com.au). This attribution helps us showcase our work and supports our marketing efforts. It will remain on your website as long as our services are being used or until otherwise agreed upon in writing.
