Terms and Conditions of Your Agreement with Kila Marketing

1. Acceptance of Terms Please read these Terms and Conditions (“Terms”) carefully before using the Kila Marketing website (www.kilamarketing.com.au), which is operated by The Acne Heroes Pty Ltd trading as Kila Marketing (“we”, “us”, or “our”). By accessing and using our Service, you accept and agree to be bound by these Terms. These Terms apply to all visitors, users, and others who access or use the Service. Your agreement is confirmed by selecting the ‘I’ve read & accepted the terms & conditions’ checkbox during the sign-up process on our website.

2. Legal Agreement This document, including any amendments or written agreements later agreed upon, constitutes the entire agreement between you (the Client) and us regarding our Services.

3. Purchases and Payments

• Initial Payment: Upon signing up, an initial setup fee will be charged to your nominated credit card. Our services will commence only after successful payment processing. The setup fee is non-refundable.
• Subscription Billing: Our services are billed on a subscription basis. You will be billed in advance on a recurring basis, starting from the day of your sign-up. The specific billing terms, including amounts and intervals, will be stated in your subscription agreement. Automatic monthly charges will be made to your nominated credit card, unless otherwise agreed in writing.

4. Fixed Term Agreements For services purchased on a fixed term basis (3, 6, or 12 months), you will be billed in advance as per the agreed schedule. These agreements auto-renew at the end of each term unless you notify us in writing of your intention to terminate before the end of the current term.

5. Service Pause and Resumption Services may be paused with a two-week notice via email, subject to a maximum pause period of four weeks unless otherwise agreed. If services are not resumed as scheduled, a cancellation fee equivalent to one month’s service will be charged.

6. Termination

• Subscription Clients: To terminate your subscription, a 30-day written notice is required. Services will continue until the end of the notice period. All outstanding fees must be paid within 7 days of termination.
• Fixed Term Clients: Early termination of fixed term agreements requires payment of all remaining dues for the term. Notification must be in writing, and all payments must be cleared within 7 days of cancellation.

7. Late Payment Failure to pay invoices within 7 days after due may result in debt recovery actions at your expense. This includes penalties and legal fees.

8. Google Ads Management We will manage your Google Ads account and will aim to optimise it. However, we are not liable for the performance of the ads or for any costs that Google may charge. You must manage and maintain your relationships with Google and any third-party platforms independently.

9. Search Engine Optimisation (SEO) We provide SEO services aimed at improving your website’s search engine ranking. However, due to the unpredictable nature of SEO, we do not guarantee specific rankings or results.

10. Modifications to Terms We may modify these Terms at any time. Updated terms will be posted on our website. By continuing to use our services after these changes are posted, you agree to the revised terms.

11. Marketing Attribution As part of our service, we reserve the right to include a discreet attribution link stating “Marketing by Kila Marketing” in the footer of your website. This link will be placed in a non-intrusive manner and will link back to our website (www.kilamarketing.com.au). This attribution helps us showcase our work and supports our marketing efforts. It will remain on your website as long as our services are being used or until otherwise agreed upon in writing.
